If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data are processed according to Art. 9(1) GDPR. In the case of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your end device (e.g., via device fingerprinting), the data processing is additionally based on § 25(1) TDDDG. The consent can be revoked at any time. If your data is required to fulfill a contract or to carry out pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if it is required to fulfill a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be based on our legitimate interest pursuant to Art. 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following sections of this privacy policy.

Processing of Customer and Contract Data

The data processed includes the master data (e.g., names, addresses) of our contractual partners, contact data (e.g., email addresses and phone numbers), as well as contract data (e.g., services used, contractual contents, contractual communication, names of contact persons), and payment data (e.g., bank details, payment history).

As part of the use of our online services, the IP address and the time of each user action are stored. Storage is based on our legitimate interests as well as the users' interest in protection against misuse and unauthorized use. This data is generally not passed on to third parties unless it is necessary for the assertion of our claims according to Art. 6(1)(f) GDPR or there is a legal obligation according to Art. 6(1)(c) GDPR.

Recipients of Personal Data

In the context of our business activities, we work with various external parties. In some cases, the transmission of personal data to these external parties is necessary. We only pass on personal data to external parties if this is necessary for the fulfillment of a contract, if we are legally obliged to do so (e.g., transfer of data to tax authorities), if we have a legitimate interest in the transfer according to Art. 6(1)(f) GDPR, or if another legal basis permits the data transfer. When using processors, we only pass on personal data of our customers on the basis of a valid processing agreement. In the case of joint processing, a joint processing agreement is concluded.

For the validation of e-invoices, the necessary data is transmitted to the external service provider https://erechnungsvalidator.service-bw.de/. An automated evaluation is carried out there, the result of which is then displayed in xBillCon.

Revocation of your consent to data processing

Many data processing operations are only possible with your explicit consent. You can revoke consent already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OUTWEIGH YOUR INTERESTS, RIGHTS AND FREEDOMS OR THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT ADVERTISING PURPOSES, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING AT ANY TIME; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT ADVERTISING PURPOSES (OBJECTION PURSUANT TO ART. 21 PARA. 2 GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged violation. The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

Right to information, rectification and deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of data processing and, if applicable, a right to rectification or deletion of this data. You can contact us at any time with regard to this or other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to check this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21 para. 1 GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If, after concluding a paid contract, there is an obligation to provide us with your payment data (e.g. account number for direct debit authorization), this data is required for payment processing.

Payment transactions via Stripe (https://stripe.com) are carried out exclusively via an encrypted SSL or TLS connection. With encrypted communication, your payment data that you transmit to us cannot be read by third parties.

Objection to advertising emails

The use of contact data published within the scope of the legal notice obligation for sending unsolicited advertising and information material is hereby rejected. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam emails.

4. Data collection on this website

Cookies

Our websites use so-called “cookies”. Cookies are small data packets and do not cause any damage to your end device. They are either temporarily stored for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or your web browser deletes them automatically.

Cookies can come from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or displaying videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies that are required to carry out the electronic communication process, to provide certain functions you have requested (e.g. for the shopping cart function) or to optimize the website (e.g. cookies to measure the web audience) are stored on the basis of Art. 6 para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG); consent can be revoked at any time.

You can set your browser to inform you about the setting of cookies and to allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Cookiebot / Usercentrics

We use the consent management service Cookiebot by Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark (Usercentrics). This enables us to obtain and manage the consent of website users for data processing. The processing is necessary to fulfill a legal obligation (Art. 7 para. 1 GDPR) to which we are subject (Art. 6 para. 1 sentence 1 lit. c GDPR). The following data is processed using cookies:

Your IP address (the last three digits are set to ‘0’). Date and time of consent. Browser information. URL from which the consent was sent. An anonymous, random, and encrypted key. Your end-user consent status as proof of consent.

The key and consent status are stored in the browser for 12 months using the “CookieConsent” cookie. This retains your cookie preference for subsequent page requests. Using the key, your consent can be verified and tracked.

If you enable the “collective consent” service feature to enable consent for multiple websites through a single end-user consent, the service also stores a separate, random, unique ID with your consent. If all the following criteria are met, this key is stored encrypted in your browser in the third-party cookie “CookieConsentBulkTicket”: You enable the collective consent function in the service configuration. You allow third-party cookies via browser settings. You have deactivated “Do Not Track” via browser settings. You accept all or at least certain types of cookies when giving consent.

The functionality of the website cannot be guaranteed without the processing.

Usercentrics is the recipient of your personal data and acts as a processor on our behalf.

The processing takes place within the European Union. For more information about objection and removal options regarding Usercentrics, visit: https://www.cookiebot.com/de/privacy-policy/

Your personal data is continuously deleted after 12 months or immediately after the termination of the contract between us and Usercentrics.

Please refer to our general notes on the deletion and deactivation of cookies above.

5. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we need your email address and information that allows us to verify that you are the owner of the provided email address and agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data exclusively to send the requested information and do not pass it on to third parties.

The processing of the data entered into the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke your consent to the storage of the data, the email address, and its use for sending the newsletter at any time, for example via the “unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you provide for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and deleted from the newsletter distribution list after you unsubscribe or once the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR.

Data stored by us for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist, if necessary, to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). The storage in the blacklist is not time-limited. You can object to the storage if your interests outweigh our legitimate interest.
